  • PROTECTING CHILDREN FROM SEXUAL ABUSE BY THOSE ENTRUSTED WITH THEIR CARE - The Florida Legislature passed the "Keeping Children Safe Act" in an effort to prevent sexual abuse during visitation pursuant to judicial determinations from those persons the child is ordered to visit. Alex Caballero co-wrote this article that provides insight to the Act and those it is intended to protect. The article was originally originally published in The Florida Bar Journal, Volume 82 Number 3, March 2008.

  • ADVERSARIAL COOPERATION: A CONCEPT THAT WORKS - Adversarial cooperation is cooperative competition. These terms mean lawyers working together to create an environment in which information is readily exchanged; legal and factual issues are discussed and either resolved or simplified and highlighted for presentation to the court; logistical problems of discovery, depositions, hearings and trial are handled in a non-confrontational way between counsel and their staffs; and both sides make every attempt to move the case to resolution as simply, expeditiously and cost-efficiently as is reasonably possible under the circumstances of each individual case.

The Statue allows any person who is a family or household member, who is the victim of any act of domestic violence, or has reasonable cause to believe he or she is in imminent danger of becoming the victim of any act of domestic violence, to file a sworn petition for injunction for protection against domestic violence.   • THE TEN MOST FREQUENT ERRORS MADE BY BUSINESS APPRAISERS - This presentation explores the most common errors committed by business appraisers in the matrimonial law area. The most common errors are concentrated in two areas: the valuator's credibility and courtroom presentation. Errors committed by appraisers in the process of preparing their opinion as to valuation or in preparing to testify are examined. Helpful hints are given to avoid traps for the unwary.
